It is also mentioned that our sales are only available to private customers registered on the jardaboardshop.com website. You are responsible for maintaining the confidentiality of your account and password, restrictions on access to your computer or other equipment. To this end, you acknowledge that you are responsible for all activities arising from your account. You are committed to creating and using only one account. Otherwise, in the event of creating and/or using multiple accounts, we reserve the right to close fraudulent accounts and cancel your ongoing orders.

To order on our Website:

  • Access your personal account;
  • Benefit from our sales by selecting the items of your choice;
  • Once you have completed your purchases and validated your cart, "Finalize order" and choose the address and delivery method for your order;
  • Then choose your method of payment, accept our full TSU and proceed with the secure payment of your order.

Please note that our product offers as well as our prices vary during the period of sale and based on the limit of available stocks. It sometimes happens that an ordered product is no longer in stock. You will be informed of this situation by e-mail and will be refunded the corresponding amount within a maximum period of fourteen (14) days after being informed of the unavailability of the product. The refund will be made using the method of payment used at the time of your initial purchase (*exceptional cases may require an IBAN from the account holder used for payment).

In addition, we reserve the right to cancel your order for a legitimate reason, namely in the following cases:

  • When a manifest error occurs in relation to the product and/or the price (for example, when a manifestly negligible price is displayed and/or when there is an error about one of the essential characteristics of the product);
  • When there is any kind of dispute regarding the payment of your order;
  • When we find a fraudulent use of our benefits and/or discount vouchers, promotions;
  • When we see the creation of multiple accounts for a single user member. *(cf. clause 2).

We also reserve the right to take all useful measures to stop such irregularities (for example: blocking or deleting the account).

Fixed price

The listed price corresponds, as a general rule, to the price recommended by a brand or its representative that was verified through a representative sample in order to ensure that it is effectively charged by the brand or by one or several known merchants.

We can then use as fixed price the price usually charged by these merchants for a product of comparable quality and composition.

They do not include preparation and shipping costs that are informed to you when your order is validated.

For a delivery to a Member State of the European Union, the Value Added Tax (VAT) will be the one in force in Portuguese territory.

For a delivery to a destination outside a Member State of the European Union, Value Added Tax (VAT) will not be charged. The same will be charged to the customer by the customs authorities in the country of destination of the order.

5.1 - Payment methods

 

Payment is made online via credit or debit card, Paypal, Google pay, Microsoft pay, Apple pay, Alipay, ATM, MBway, Payshop, Giropay, Bancontact, EPS, Ideal, Przelewy24 and WeChat Pay some payment methods only available for some countries.

Bank cards accepted are: Visa / Mastercard / Maestro / American Express / Discover and JBC.

After confirmation of payment by our payment center, payment will be debited within a maximum period of 4 days after the order date.

If payment is not made within the stipulated period, Jardaboardshop.com reserves the right to cancel orders under “Awaiting payment”.

  

5.1.1 - Payment by PAYPAL

In case of payment by Paypal, the purchase amount will be automatically debited from your Paypal account. This payment method is a single, synchronous, shipment-based payment method. This means that the customer takes steps to authorize the sending of funds through a redirect. There is immediate confirmation of the success or failure of a payment.

 

 

5.1.2 - Payment by GOOGLE PAY, MICROSOFT PAY and APPLE PAY

In case of payment by Google pay, Microsoft pay or Apple pay, the purchase amount will be automatically debited from your account. This payment method will be processed by the STRIPE company and is only available for certain countries. This payment method is a single, synchronous, shipment-based payment method. This means that the customer takes steps to authorize the sending of funds through a redirect. There is immediate confirmation of the success or failure of a payment.

Your device and browser must support the payment method.

 

 

5.1.3 - Payment by ALIPAY

In case of payment by Alipay, the purchase amount will be automatically debited from your Alipay account. This payment method will be processed by the STRIPE company and is only available for certain countries. This payment method is a single, synchronous, shipment-based payment method. This means that the customer takes steps to authorize the sending of funds through a redirect. There is immediate confirmation of the success or failure of a payment.

 

5.1.4 - Payment by MULTIBANCO

In the case of payment by ATM, the Customer has until midnight the following day to make the payment on an ATM platform or on his Internet Homebanking.

Until payment is confirmed, orders placed with this option on the Site will be in "wait payment by ATM" mode and will not appear in the "Orders" section. This method of payment will be processed by the company IFTHEMPAY and is only available for some countries.Our Multibanco entity is: 12178 .

 

5.1.5 - Payment by MBWAY

In the case of payment by MBway, for orders to be carried out successfully, the payment must be confirmed within a maximum time of 10 minutes, in the Mbway application on your mobile phone or on your tablet. After this period, the purchase order expires and it will be necessary to repeat the entire process to receive a new notification. This payment method will be processed by the company IFTHEMPAY and is only available for some countries.

 

5.1.6 - Payment by PAYSHOP

In the case of payment by Payshop, the Customer has until midnight the following day to make payment at a Payshop store or payment point.

Until payment is confirmed, orders placed with this option on the Site will be in "wait payment by payshop" mode and will not appear in the "Orders" section. This payment method will be processed by the company IFTHEMPAY and is only available for some countries.

 

5.1.7 - Payment by GIROPAY

In case of payment by Giropay, the purchase amount will be automatically debited from your Giropay account. 5.1.8 - Payment by BANCONTACT

In case of payment by Bancontact, the amount of the purchases will be automatically debited from your Bancontact account. This payment method will be processed by the STRIPE company and is only available for some countries. This payment method is a single, synchronous, shipment-based payment method. This means that the customer takes steps to authorize the sending of funds through a redirect. There is immediate confirmation of the success or failure of a payment.

 

5.1.9 - Payment by EPS

In case of payment by EPS, the amount of purchases will be automatically debited from your EPS account. This payment method will be processed by the STRIPE company and is only available for certain countries. This payment method is a single, synchronous, shipment-based payment method. This means that the customer takes steps to authorize the sending of funds through a redirect. There is immediate confirmation of the success or failure of a payment.

 

5.1.10 - Payment by IDEAL

In case of payment by Ideal, the amount of the purchases will be automatically debited from your Ideal account. This payment method will be processed by the STRIPE company and is only available for some countries. This payment method is a single, synchronous, shipment-based payment method. This means that the customer takes steps to authorize the sending of funds through a redirect. There is immediate confirmation of the success or failure of a payment.

 

5.1.11 - Payment by PRZELEWY24

In case of payment by Przelewy24, the purchase amount will be automatically debited from your Przelewy24 account. This payment method will be processed by the STRIPE company and is only available for some countries. This payment method is a single, synchronous, shipment-based payment method. This means that the customer takes steps to authorize the sending of funds through a redirect.

There is immediate confirmation of the success or failure of a payment.

 

5.1.12 - Payment by WECHATPAY

In case of payment by WeChat Pay, the purchase amount will be automatically debited from your WeChat Pay account. This payment method will be processed by the STRIPE company and is only available for some countries. This payment method is a single, synchronous, shipment-based payment method. This means that the customer takes steps to authorize the sending of funds through a redirect.

There is immediate confirmation of the success or failure of a payment.

 

 

5.2 Secure Payment

 

All your purchase transactions take place within a restricted scope of confidentiality and encryption thanks to the SSL protocol. We do not have access to your bank details nor do we keep them on our servers.

If you wish, your bank card details can be stored securely by our partner banking institutions to be used when making your next payments on the Site.

5.3 Anti-Fraud Policy

 

We use several mechanisms in the fight against fraud:

5.3.1 - When you click on the “Validate” button upon completion of your order, our bank checks the validity of your bank card number and certifies its compliance. This protects you from abuse and fraud.

5.3.2 - Our website also uses a program called “3D Secure” which provides for the introduction, at the time of online payment, of a transaction activation code communicated by your bank with a view to completing the purchase (via forwarding to the website from your bank and receiving an SMS or personal questions such as date of birth, zip code, etc.).

5.3.3 -We carry out controls aimed at ensuring the veracity of your identity and address. In this context, our checks focus on the information you provide us with, such as first name, surname, email address, delivery address, etc., as well as the IP address used and that appears in the history of your orders and transactions, the characteristics of the order in question and finally the bank card used (for example: country of issue and partial numbers communicated by banking and payment institutions, consisting only of the first six numbers and the last four, as well as their expiry date).

 

We reserve the right to cancel the order in question and block the account if the checks reveal the provision of inaccurate data or in case of non-receipt of the requested supporting documents within the established period. 6.1 Where and how can it be delivered to you?

6.1.1 Home delivery

When placing your order, choose the delivery option.

Please note: We have no control over delays in deliveries due to security measures by customs authorities or

remote areas or any other inconvenience.

When the order leaves our premises, we do not have control, but the logistic entities we work with do.

For logistical and security reasons, we do not deliver to military barracks.
In case of absence from your domicile, the carrier in charge of delivering your order will inform you of the modalities of collection of your order through

a pass notice.

6.1.2 Delivery to Collection Point

Upon completion of your order, choose delivery at the collection point. To find out which Collection Points are closest to your home, simply enter your address and immediately identify the different and closest Collection Points. Please note: For bulky items, pickup points are available but they are fewer in number. You will find the list on the Site providing your address.

· In case the Collection Point is closed, the package is automatically redirected/available at the nearest Collection Point

· You have a period of fourteen (14) calendar days to pick up your order at your pick up point.


We draw your attention to the following points:

- In some cases, we may deliver multiple times (namely if you placed multiple orders on multiple sales). In this case, you will always be informed.

- Delivery times are indicative and may vary according to sales. You are informed when your order is validated.

- In case the order is returned to our facilities as a result of the impossibility of delivering the latter, you may request us a new delivery within a reasonable additional time by registered letter with acknowledgment of receipt or other written document in a durable medium. If you do not request a new delivery within ninety-six (96) hours after returning the order to our facilities, we will cancel the order and promote the refund of the amount paid to your bank. Without prejudice, we will notify you of the return of the order via email.

 

 

6.2 What is the cost of delivery?

The amount of delivery charges for your order will be communicated to you when choosing your delivery method. Rates for home delivery or pick-up will be offered to you so that you can make your choice in full knowledge of the facts!

 

6.3 What to do in case of shortage, late delivery or non-conforming delivery?

You have a period of thirteen (30) calendar days to exercise your right of withdrawal from the receipt of the products; You can exercise your right of withdrawal by sending the form below or by making any other unequivocal statement to that effect to the email support@jardaboardshop.com

 

7.1 How to return a product to us?

 

1. Enter the website and make the "Sign in";

2. Select the option "My Account", followed by "Order Manager"

3. Choose the order, then select "Return Form" of the product you want to return

4. Fill out and submit the form;

5. Prepare your order by repackaging the items in their original packaging or, failing that, in an adapted packaging (see below how to pack your item), insert the return form inside and paste the return note on the packaging ( the note must under no circumstances be stuck to the product).

6. Finally, deliver your package to the carrier to be sent to the following address:

Once the return request has been registered, you must resend your product within a maximum period of fourteen (14) calendar days.

7.2 How to pack your product for return?

It is important that the products you return to us are properly packaged so that they do not suffer damage in transit. For this purpose, take care to protect them correctly, ideally in their original packaging.

You have the right to inspect, with due care, the nature, characteristics and functioning of the purchased products. However, if you have exercised the right of free withdrawal and intend to return the purchased products, you will be liable for the depreciation of the products whenever the manipulation carried out to inspect the nature, characteristics and functioning of the products exceeds the manipulation normally allowed in a commercial establishment.

The products must be correctly protected upon return, must be returned in the proper conditions of use, must not be damaged, dirty or with traces of manipulation that exceeds the handling normally allowed in a commercial establishment, and must be accompanied by all possible accessories.

Packages for which we cannot identify the sender (first name, surname, address, order number) cannot be received.

 

7.3 How much does the return cost you?

In case of exercising the right of withdrawal, the return expenses are borne by you except if the order is canceled when in state "Preparation in course"

7.4 Exceptions to the right of withdrawal

You cannot exercise your right of withdrawal with respect to:

- - services that have been provided in full during the period of free withdrawal with your prior express consent for which you have acknowledged that, in that circumstance, you have lost the right to free withdrawal;

- products or services whose price is a function of fluctuations in financial market rates that are beyond the professional's control and are likely to be produced during the withdrawal period;

- products manufactured to customer specifications or clearly customized;

- products likely to deteriorate or perish quickly (eg foodstuffs or liquids);

- products whose seal has been damaged by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;

- products that after being delivered and due to their nature are indissolubly mixed with other items;

- the provision of accommodation services, with the exception of residential accommodation, transport of goods, car rental, catering or leisure activities which must be provided on a specified date or period;

- digital content not provided on a material medium, the execution of which began after express prior consent of the consumer and express waiver of his right of withdrawal.

 

7.5 When is it refunded?

Exercising the right of withdrawal gives rise to a refund of amounts paid within fourteen (14) days of receipt of the package. This period may be extended until the day of receipt of your packaging if you cannot prove the shipment of your products.

The refund will be made by reverse transaction (bank transfer and/or voucher). However, we will not be obligated to reimburse you for additional expenses, such as the cost of shipping and transportation or any other service purchased.

All our products benefit from statutory guarantees, namely the statutory compliance guarantee and the hidden defects guarantee. Certain products also benefit from a commercial guarantee proposed by the supplier that determines its conditions.

8.1 Legal guarantees

We are responsible, as sellers, for defects in the conformity of the products we sell and for hidden defects.

The legal guarantee of compliance applies when your product has a compliance defect, for example when your product does not function in accordance with the uses for which this product is normally used, or when it does not correspond to the description provided.

The hidden defects warranty applies when your product has a hidden defect, that is, a defect not apparent at the time of sale that makes the product unsuitable for your use or significantly reduces such use.

If you act in accordance with the legal guarantee of compliance:

- - you benefit from a period of two (2) years from the delivery of the product, the date on which you have detected the lack of conformity to act, provided that the non-compliance occurs within two (2) years from the delivery of the product; ;

- - you are entitled to have the product restored to conformity free of charge, through repair or replacement, to maintain the product at an appropriate reduction in price or to terminate the contract (return and full refund).

The statutory guarantee of compliance applies regardless of any commercial guarantee granted.

You can decide to trigger the hidden defects warranty. You can choose between repairing or replacing the product, subject to the estimated cost conditions;

 

 

8.2 The commercial guarantee

In certain cases, a commercial guarantee may be proposed directly by the suppliers we work with. If this is the case, you will be informed in the description form for the products in question, but also in the invoice for your products. In case of doubt, you can also contact our Customer Service to find out if the product benefits from a commercial guarantee.

 

8.3 How do I activate my warranties?

If you wish to benefit from one of the guarantees, please contact us by clicking here, or, if applicable, send us a request to the following address: support@jardaboardshop.com. Don't forget to enclose your order number.

You will then receive a pre-paid label to place on the packaging to return your non-conforming product to us. Once your product is returned, the non-compliance will be controlled by our teams. In case of a false declaration, a fixed amount of 6.50 € will be deducted from your refund.

 

 

8.4 Exclusions

Products that have been modified, repaired, integrated, added or misused cannot benefit from the warranties.

In the event of a dispute, you can turn to the competent consumer alternative dispute resolution body. Without prejudice to the legislation, statutes and regulations to which the consumer alternative dispute resolution entities are bound, the consumer may opt for the European online dispute resolution platform available at https://webgate.ec. europa.eu/odr, by the alternative consumer dispute resolution entity in the place of your domicile or by the alternative resolution entity with specialized competence, if it exists for the sector in question. You can consult the updated list of all alternative consumption resolution entities available at www.consumidor.gov.pt.

If no friendly solution is found, the Portuguese courts will be competent.
